They have no conclusive proof it is water and would not give a % as to how sure they are.

They have not found water, just VERY VERY strong evidence that water has gushed over the surface of mars in the last few years.

That said, they are fairly confident, then they were confident about there being evidence of life in the mars meteorite ALH 84001.

It was on Sky news also, to me it looks like a recent sand slide, I didnt think water could exist at that atmospheric pressure (6-10 millibars) at that temperature !!

They think the water burst out from under ground and would have been "boiling" as it went. So it could have persisited long enough to cause the gully. The reckon that sand slides and other debris flows would show up as darker than surrounding regions, hence they use this as a good indicator that its water

Mars: Recent Gushing Water and New Craters

A pair of significant discoveries about the red planet appears in this
week's journal Science: evidence that, within the past five or seven
years, water gushed on Mars in two gullies, and 20 new impact craters
formed on the planet. The evidence comes from NASA's Mars Global
Surveyor, managed by JPL.
